I may have won the lottery I got a confirmation the contract is on its way today. They tried to sell me a one time payment lease I did not bite I want a monthly payout looks like they are going to lease it on a monthly payout. . I have surfed the net and learned the ins and outs on how to up the lease I don't want to run them off any one have any tip's.

They are looking to install a 220 ft tower on a 12 acre track I brought just as a buffer from the neighbors. I never had any plans for the land other than a buffer. I wonder if they will give me some type of escrow money to cover my exspence of having a real estate lawyer look over the contract.
 
We recently got a preliminary offer to place a tower on our church property. There weren't any details of what they have in mind.

We don't have much property to put a tower on, they may be wanting to put some cell antennas on the steeple or the building.

I can't see the city allowing a tower or much anything visible there, it is in an historical district and they are very picky about what we do.

Whatever the plan, the money would truly be a Godsend!

e have a few churches here where the equipment/antennas are hidden inside the church structure where no one ever knows they are there....bell tower, steeples, etc.
 

Now that you have done your research. Obtain a good contract lawyer and don't let on how much you know.
If the contract lawyer turns out to be on your side. he will write an agreement covering about 50 loopholes that you have missed.
 
Sa others have mentioned get a good lawyer to look it over.

Monthly lease is a good thing, also add a clause that they pay
The yearly property taxes, maintain the access road and keep the vegetation cut.

I often wonder what will happen to these towers or even windmills after there no longer needed? Who will be responsible for taking them down and cleaning up the site? There's going to be a big chunk of concrete there . Also if it's a limited liability corporation then if they go broke who's responsible after all they can break these into individual units that way they are not financially bound together if one has problems that part could go broke and the individual responsible would be protected but you would be stuck.

Those towers will just be there forever. If the company that put them there goes belly up, there will be no money available for the deconstruction. If there is no money, a lawsuit will accomplish nothing. Even a direct court order won't do anything. Those towers will just be there until they deteriorate and fall down.
 

A lot of folks in the early days negotiated free cell phone service for the life of he contract in addition to the payment. But now there is a independant company providing the towers to ALL CELL PHONE companies, so thats hard to do anymore.

This! a good lawyer will, as was mentioned, think of all the things you never thought of....good luck.

Or they will continue to change carriers and each one has to honor the original contract or negotiate a new one.

Tower on one of our properties, has had five different owners
in the 20 years it's been up.

Every time the new owner start balking at the contract
I tell them to bring a shovel and breaker and they can
put it where they want.

Still getting monthly payment.

I know a guy at the north edge of Terre Haute is getting about $550 a month for cell phone tower. Cell tower is located in a flood plane along river. Not much good for anything else. Tower has many support wires too.

Will they pay you to mow it, or can you harvest hay off field?

My only concern would be having it close to buildings or where kids play. Electromagnetic radiation from power lines, Low frequency radiation, is linked to some forms of cancer. There seems to be an endless discussion if cell phones cause brain cancer. I can't imagine how much radiation would come off a cell tower. I would research the danger. Post back let us know what you find.

From the other side of the coin, you wouldn't be living in a Verizon dead zone like I do at both my locations.

The land is in timber I don't have enoufh to get in a timber tax deal. Everyone I have talked to that has a tower on there property seams to be a happy camper. I am surrounded by major power lines "Whats that hum you hear I don't hear it".

If power lines are closer than tower, then radiation can't be any bigger deal then power lines. It should be a no brainer. What can you lose in a woods? Good chance they will clear you a road to get to tower and possibly keep it cleaned out. Then my only concern then would be keeping the boys using ATV's as mobile meth labs out of there. Perhaps you could get free cell phones for life in on the deal. GO FOR IT. geo
