Much more likely to be the seal between the clutch housing and rear frame. The suction tube will be completely below the oil level when the transmission is at the full mark. The o ring (quad ring) seal is above the oil level which allows air to enter. A small leak will allow the oil to drain back through the filter when the engine is off creating an air bubble which the front pump has a hard time clearing. A pump with some wear on it has an even harder time. It will not do any harm to run the system with an extra five gallons in it.
