The operative word here is "IN". Unless the pedestrian is IN the crosswalk, he/she does NOT have the right of way to enter the crosswalk until traffic is clear. That is simply common sense. IN the crosswalk means IN the crosswalk - not "approaching" or "ready to enter" or anything else.
Stopping for said pedestrian to ENTER the crosswalk is a matter of personal COURTESY. I would offer the same courtesy to a pedestrian, BUT he does NOT owe the lady a watermelon.
