I sold a JD 3020 tractor to a fellow out in CA. He paid me by wire transfer. He was to call when he had arranged transportation. I waited and waited nothing happening. At first I could get ahold of him and he stated he was "working" on it. Then later no contact. I stored the tractor for close to three years. I finally figured some storage cost and deducted it from what he gave me. I sent a cashiers check to the address I had for him for the "adjusted: balance. I never heard anything but the check was cashed. I then resold the tractor.
Another one. I had an equipment auction in 1989. I down sized after going to town to work and I also had a lot of hog equipment that I no longer needed. One of the things I had accumulated was this two row IH three point corn planter. Nice little planter. I have never seen another one exactly like it. The bottom lift link was just a cross drawbar slide into/across the frame. A fellow bought it at the auction for $175 and he took the drawbar with him. He told me he would come back in the next week or so to get it. I just rolled it back into one of the hog floor sheds. In 1998 I sold that house and buildings. The planter was still in the shed. The new owner said he would like it to plant garden with. Several years after that the original buyer stopped there and tried to pick it up. LOL He got mad when the new owner would not give it to him after leaving it for over ten years.
SO on your deal, try once or twice more to contact him. If you can not reach him then just resale the tractor. If the other fellow shows back up later it is your call on whether or not to refund any of the deposit or not. What he gave you was just that a deposit towards the final sale. He never completed the sale so the money is not really against the tractor anymore. You see non-refundable deposits on many types of transactions. That is what this is in my mind after six months to a year.
