Well, many may not agree with the way I see it, but this is the exact reason why I refuse to take down payments. I will always work with a potential buyer, such as set an arranged day and time for full payment and pick up, but no down payments to hassle with. If they show up on said time and day with cash, deal is over and done. If they don’t show, I’m not out anything, and I owe nobody nothing. It is still my machine 100%, no questions asked. I was actually threatened with a lawsuit when someone gave me $250 down on a haybine that was to be picked up the following week and paid for in full at that time. Well, buyer kept dragging things out, I’m sure because he couldn’t pay for it, but also refused to take his down payment back. I tried multiple times, but he always refused saying he had a deal made to purchase it, and if I sold it to someone else he would sue. I don’t know enough about these kinds of things to know if it was just a meaningless threat, or not, but that incident turned me off of down payments for good. Final outcome was my dad knew a gal who was a secretary for an attorney before she retired. She helped us draft an “official looking” letter that strongly encouraged the potential buyer to accept the refund and stop pursing the sale of this machine. Thankfully, it did work!
