I think you're confusing "free speech" with "privacy". The fact is, pretty much anything you say in public could always be used against you in a court of law. It just that it's a lot more difficult to say anything today without someone listening. As far as privacy goes, your privacy is slowly going away, probably in ways you never even noticed. Case in point: Those supermarket discount cards, do you realize that they are used to track every single purchase you make? Yep, Kroger knows exactly how many tubes of Preparation H you went through last year. There was a recent case where a man was (wrongly) arrested for arson because his Safeway discount card showed that he had recently purchased fire starter sticks. I could post more examples, but my point is that we have NO privacy, and we don't even know when we lost it.
