The cotter key is there to keep the drain hole clear of debris. (It shakes and rattles when you"re driving.) You probably have a bad seal either from the back of the engine or the front of the transmission. That"s where the leaking oil comes out. Sorry. But if it"s just a little and you don"t mind it marking its territory when you park, just keep your eye on the levels and live with it, unless your clutch starts slipping.
