time limit to pick up a tractor with deposit.

If a deposit and receipt was payed,how long should a person wait for a tractor to be claimed in Michigan? I know morally and legally answers will be different for different people.

id seller place stipulation on it? If not, perhaps he should contact the buyer. Otherwise the obligation might just be "forever".

Sitting in my yard is a JD 620. It will be a year next month. I made the repairs the owner wanted. He has never came back or contacted me. Owes me $460.00.

I'm guessing you are in the same boat I'm in. Just sitting a d waiting.
 
I know in the cast of things like rental storage if there is no payments after a year the item can be sold.
 
I had a similar problem a few years ago.

I sold a tractor only because I needed room. The buyer paid for it but after three months had not yet picked it up so I sent him a letter stating that I would start charging $50 month storage if not picked up in 30 days.

Didn't take long for it to be gone.

Don't know but I have a tractor that was paid in full and the buyer passed away before he came to get it. Will need to do something with it eventually.
 
I guess that depends on the situation. I know if I paid a deposit or a in full and ask if I could pick it up later I'd stipulate at time frame and then be in contact with the seller.

If I sold something again I'd put a time limit on it.

In a case like that I'm guessing legally now the estate owns the tractor. You might want to contact the courthouse to find out who the executor of the estate is.
 
I sold an implement in April of Last year and the guy paid for it in full then asked if he could pick it up in a couple of months and I said yes. It was still at my place come September last year. I tried to get a hold of the guy and say I was reselling it if he didn't pick it up by the end of October. I had trouble getting in touch with him since he had a buddy of his buy the implement from me thru ebay. He finally called me and said to go ahead and resell it and he would just pay his buddy. After all that time I couldn't believe he hadn't paid his buddy yet. I resold it for the same price as I did the first time. Didn't feel guilty about it either. Been selling on ebay too long I guess.

Around here you have an automatic mechanics lien on that tractor, even supersedes a bank lien. And if you file it you can charge monthly storage fee's, Once the repairs and storage equal the value of the tractor its yours.
 
I would think the right thing to do would be to re-contact the deposit payer. Specify to them, that if they don't finalize the deal and pick the tractor up within 30 more days upon you notifying them, they will then forfeit the deposit and have no further claim to the tractor. Hopefully this will speed things along. If not, then you can re-analize what to do at the 30 day mark. Hopefully they finalize the deal, and you wont have to do nothing more. If not, you might want to get legal advice pertaining to what's legal in your state. That's what I would do.

Just let them know that you appreciate them letting you use the tractor while it is still there....they will be there pronto!
 
Moral and legal certainly isn't the same. I have been selling one of my hobbies down a bit over the last 4-5 years and it's been a learning experience. In retrospect it is best to wait on a buyer who cant wait to haul it away. Otherwise experience has taught me that if the item takes up enough space to aggravate then set a definite time table. Small items depends on your ability to keep track of who owns what. How long I would wait depends on how much was paid down? A small deposit is certainly different deal than having half the money or more in pocket. For 10% I wouldn't wait over a few months. If I had half maybe 3-4 months?? I dont know, depends on if the guy returns calls or has placed you on the ignore list.
 
Whenever selling something over distance I tell the buyer up front that they have a set time (usually six months) for pickup -- I have them sign a statement when sending a check/payment that says they agree -- if they cannot pick the item up in the agreed time frame then their deposit/payment is forfeited and I put it back up for sale.
I have a tractor in the yard right now that I received a deposit for in May -- six months is almost up and I have not heard a word from the buyer. I dont understand leaving something out there for that long -- the longest I have ever gone between buying and pickup is about a month and I felt bad about that!
 
Well lets see JD 620, $480. I will pay the repair bill and of course take the tractor away!!!!!
 
I have a Car Crawler a fellow bought and paid for back in 1981 and its still here,I know him so it no big deal.If I died he better get here quick before the scrappers get it(LOL)
