Why is it that if you turn some one n for say dumping trash in a sink hole DNR thinks you are in the wrong but if thy take a report you are removing gravel from a creek that the person who turns you in has to trespass to do so they are in the right
 
Ran into a similar situation about a guy who was poaching deer...DNR didn't really want to know about it, the details of when and where he was trespassing and spotlighting and shooting from the road. Even though that was 25 years ago, it still taints my view of the DNR.

Poacher was shot and killed at a convenience store parking lot for no [apparent] reason a couple of years later, so I guess that one finally got taken care of.

DNR is another bureaucracy...and maybe they think they stand a better chance of collecting a fine from you than from the other guy??
 
If MO is like KY, they pick thier battles and there is not much rhyme or reason to it.

I never knew dig'n rock out of your own creek was an issue, but I have learned alot of every day things are illegal from the good folks of this site.

You don't own the creek. The public does. I can legally walk down that creek you claim and fish it. You can't stop anyone from doing just that because it isn't yours alone.
 
If you drive thru a Stream in WV and muddy it you can be fined. Too do any kind of dozer work around a stream or in one is not permited with out the OK from DNR . But try to get them to do something about people dumping on you , they won't answer my calls anymore or call back when I leave a message . A few years ago they called me and wanted me to meet them at my farm , when we got there they told me they were going to fine me $100 a day for some trash someone had dumped on me. I lost it . Then proceded to tell them to take me to court and I would tell them about the dump truck load of shingles that someone had dumped in road when the state road Dept came along instead of cleaning them up they pushed them over the side of road onto me then hualed dirt & covered them up. Also told them that the trash they were talking about was in Old County Road Right-of-way that still belonged ot state , told them if they made ticket out make it to the state of West Virginia. He got in his car and I haven't seen him since .
 
In the state of Missouri the person does in fact own the creek. They do not own the water in the creek. Also only if you can boat down that creek for 9 month of more a year can some one trespass there but they can only do so in a boat and they can not step out of the boat. The creek I have you can not boat in but a couple times a year so then people can not go it to it with out my premisson which I have not given
 
Unless they have changed the law, there are different classes of streams in MO. It depends on whether or not you can float a boat down them.
There is "navigable" "public Non-navigable", and I forget the other names. The type of stream depends on where your property line is. My creek, you cannot float a boat down it, so the property line is the center of the creek. If they can float a boat, then they have a right to the water, but can't go up on the bank.

As for gravel, I think a landowner has a right to take a certain amount of gravel out.

Call Missouri Farm Bureau in Jefferson city. They have lobbied on this issue and I believe might be able to give you a little info. and they are not a govt. bureaucracy.

If someone is dumping, forget DNR, call the county sheriff. You can make them file charges, especially if you know who is doing the dumping.

Gene I keep up on the laws as far as the creek and we do have permits to mine gravel from this creek. As far as the guy dumping hes doing it on his own land so its then goes back to DNR because it is his land, but what hes doing can/will hurt the water table
 
Pretty shure KY is the same. If some one can get down it with a boat it is public property. If they can't they are tresspassing. I do know it is that way with a river. If you put your boat in the river to go duck hunting you can go anywhere you want in the flooded bottoms. The trees are still the land owner's. If you dive a boat from the river across a cornfield and tie off your boat to a tree you have to have permission from the land owner. I have several creeks on me that you can only get a small boat down a few times a year and you would only be able to go one way then! :) I pay taxes on it, I can say who hunts and traps along it, way I see it I pay taxes on the rock in the bottom too.

All I gota say is be careful how you talk with them Gov't types.

When I moved too AZ, we didn't have a building code in this county. 5yrs latter we have a building code with terrible enforcement people. They would inspect your work, tell you too make changes, then upon reinspection say it was wrong and too change it again, depending on which inspector you drawn, so if you had a new inspector each time of inspection, then you could possible never complete your project from all the changes or go bankrupt trying.

So a local Dad & Son has a air spraying bizz for the past 30yrs in the same location. The inspector comes out (a real B) and the son makes a comment to her " you know, if you fell in the vat of acid, your face would not look any different"

The son did 10yrs of hard time on that comment.
