Mornin' Guys,

I really hate being dumb as I am and not understanding something, so I'll just spill my guts and ask. Maybe some of you can enlighten me.

As you all know, the wife and I need a diversion and we are building towards a small farm and the equipment it takes to run it. Eventually, we want to cut back on this corporation and become more self-sufficient on a little farm because we are both getting up in years and we wanna just step back and slow down.

So, in pursuit of this idea and because it is so darned cheap to acquire and run, I've been buying a lot of 30-year-old equipment, paintin', fixin' it all up and parking it out in a field until the day we can start this little endeavour.

Okay, now we run into a small problem. To date we haven't been able to locate a decent operational farm to purchase and therefore cannot file as a farming entity on our taxes.

I get a call yesterday from the county assessors' office telling me that I have to come in and sign a personal property form and to bring my depression schedule.

Since we are not actively farming and cannot claim it as a farming related expense, I have a feeling I'm gonna get dinged and dinged hard on all this old junk as being considered taxable personal property.

Is this how this is gonna play out? I'm startin' to get a headache. :>(

Allen, you cannot put the equipment on your depression schedule until you "put in to use". When you do buy the farm and start farming you can then began depreciating the equipment. A hobby farmer can deduct expenses up to his income from farming but cannot take a loss on a hoppy farm. I would not suggust that you falsafy any tax return as that can lead to stiff penalties.

If it aint on the depriciation schedule you dont pay personal prop tax, thats what my accountant tells me,tell them your older equipment that you have you are buying to cut up because the iron price is high,and your scrapping it out,,sounds like one of your nieghbors is a snitch,,and ratted you out,,,we got a couple that do that here,,good ole nebraska,they said there going to tax toilet paper and get all the A--holes---billy

Boy, I don't think so, Billy.

I bought a couple of items from the local machinery dealer and they filled out that sales-tax deferment form and didn’t charge me any sales tax.

The gal at the courthouse told me that sometimes it can take up to two years for them to get all that info in the system.

So, if that's the case, I've got to make up my mind if I wanna pay the sales tax and claim it as personal property or put it on a depression schedule.

Dunno, gotta go talk to 'em.

Hi Allen...Two things fer sure...death & taxes...Personal property tax is not applied unless they know you have it, but if it is insured or you have filed expenses on them there is no way out except to rent some land and be a farmer in the dell untill you buy a farm. How many acres is required in Nebraska to qualify as a farm? A tractor restoration company can really complicate things!DEM DARE HOBO'S AIN'T GOT NO NICE TRACTORS NEITHER!Good luck...Dixieland

You can be a full time farmer and still might not be able to file as a farmer if most of your income comes from off farm sources,I farmed 500
acres,my wife had a good job,plus some interest
and a little buying and selling and I can't file as a farmer.It depends on where your located,but here in ohio machinery is not taxed,How do they know you even own any? You can file as a farmer if you have trees,crp ground,ponds etc,it doesn't
have to be just tillage,you can then deduct,fuel,
parts,equipment,repairs,travel to auctions,your
vehicles etc as a farm expense.

Allan -
Jay has the right Idea. Find a farmer friend in, say, Iowa, that you are just storing it for until they come pick it up. That way nobody gets dinged on taxes. My brother, here in SE Nebraska did the same thing. He made up a bill of sale for $50 or $100 bucks an item (REASONABLE amount) incase anyone asked.

Dennis, I am in eastern Oregon, 180 miles east of Portland few miles south of the Columbia river. Not familar with the term U/P. I remember when you came our way. If I am correct you left few tractors in storage in NC. I have a Ford 860, Case VAC, Farmall Cub. Had a Alis C, I completely restored sold it last fall.

Allan declare your self a equipment dealer and see what they say they ,then you could write off all the OVERPRICED equip still sitting on your lot that won't sell for some reason.

checkout your Hobby, it is tax deductable. pretty sure, I took off my leather tools. unless things have changed since I lived in Nebr. check it out anyway. hope this helps. Jer

Just got the same word from a fella here too. Just hope I can pull it off as a "hobby" 'cause I'm getting quite a sizeable field full of my trinkets. :>(

I swear this state is got to be the world's worst when it comes to taxes; if you breath air, ye shall be taxed.

They taxed me on the damned proceeds that went directly to the creditors, when they took it all away from me the first time around. Then, they tax me when I'm tryin' to get it all back because now I'm considered "healthy" again. Geeze!

Wyoming and South Dakota are lookin' better and better every day.

Or how's about this? Drunks, bums and hobos don't pay these outrageous taxes; maybe that's a plan. :>)

Allan, The state of Nebrasks has commissioned me to develop the first gravity meter, so they can benin charging for the gravity you use. As soon as I get some funding from my friend AKMED, I"ll have a working model. Then you folks out there will really have something to get all up in arms about. Seriously, I don"t know how badly your folks are taxed, although I think personal property tax is one of the most punitive and unjustified tax in existence. Anyone who would vote that tax on its citizens should be removed from office, although most of those thieves are long gone from politics by now. Here in Michigan, we are taxed to the point that nobody wants to start a business in this state because of taxes and regulations. And our governor has the audacity to wonder why we are laging in jobs creation. You would be better off farming at a loss to avoid paying personal property tax. Have you tried renting some ground, as opposed to buying farmland?

You got my sympathies Allen. Here in Warshington we get taxed for "surface water management", which means that you're taxed because you get rained on. With all the trees I got, I should be paid by the county, since they probably evaporate more rainfall than I actually get.

Maybe if you don't pay your taxes they will give you a free room and three squares in the Graybar Motel. The government is a business that never runs out of money (yours) and just keep coming up with new things to spend it on including the salary of those darned tax assessors.

As I understand it there is a power company in Florida that has more tax credits than they can use. They are selling tax credits to anyone who wants to buy them. The deal is that you will share your tax savings with the Florida power company to the tune of 50% and in effect become part owner in the company. You can apply these tax credits to back taxes up to three years ago or 2002.

A friend just did it with his 2002 return. He received his check, sent 50% of it to the power company, 5% to the tax attorney and pocketed the remaining 45%. He is now doing the same with his 2003 return and plans to repeat the process with his 2004 return.

Has anyone else heard of this?

On a plain piece of paper, in your own handwriting, write "I give all my tractors and implements to Jay in exchange for a six pack of beer and the sum of $1." Sign it in front of a witness and have the witness sign it. Problem solved.

HMMMM....sounds like you should barricade yourself in and shoot it out with those varmints!
Of course you will have to pay taxes on your guns and ammo too!
I would argue it as far as I could. Governments and insurance companys can NEVER get enough money.

I think that if you call it a hobby you cant take any deductions on the stuff.At least that is the way I understood it when I was trying to farm. Give yourself a name like Allans Enterprise or whatever. Better yet,talk to a tax attorney or accountant.
