Yeah, it's a lie. It means or best offer, but by when is never specified, and if the best offer is not what the seller wants he does not sell. A little like an auction where you find out when you go to pay that your high bid was not accepted by the seller even though other bidders thought you bought at that price. I've learned to ask "Is this an absolute auction" when they ask for questions at the start, after I was the high bidder on 147 acres of farm ground being sold by out of state heirs by their lawyer.
