Dealer put the wrong fluid in my machine - how bad is it?

I have an ASV RC100 with 673 hours on it. I had some work done on it by the ASV dealer at 519 hours and during that work they replaced the hydraulic fluid and the filters. Since then I had them look at the machine at 615 hours and 622 hours for track work, but both times I asked them to check the hydraulics because the machine was feeling sluggish and jerky in its movement. I just took the machine in again at 670 hours for an unrelated problem but still complaining of hydraulic problems, but they told me that the hydraulic problem was in their words, "likely caused by the hydraulic fluid that they had used which didn't meet the specs of ASV." Well, I went back and looked at my receipts and realize now that the reason the fluid doesn't meet ASVs specs is because the idiots put Kubota UDT fluid in my hydraulic system rather than ASVs Posilube or even the Kubota spec 46 hydraulic fluid.

So, the dealer has agreed to change out the fluid and filters twice in the next twenty hours and to in writing state that they will cover repairs or replacement of my hydraulic pumps if they fail. I called ASV and spoke with someone there who said all the fluid needed to come out ASAP and that I needed to open the hydraulic tank and look for metal fillings and that if I didn't see any I should be ok. So my questions for you knowledgeable people are:
1) anyone have an idea of what the likely damage is to a machine that ran with UDT fluid for 150 hours rather than hydraulic fluid?
2) what else should I get in writing from my dealer that they will cover if it fails?
3) how many hundred hours would you regard as being reasonable for them to cover (ie if I put another 200 hours on it and haven't had any more hydraulic problems am I out of the woods)?

Thank you people for any advice you can provide! I'm already switching to a different dealer so hopefully I won't have to deal with stupidity in the future.

Lot of money in that machine and not sure what could happen long term, or if there is already damage done that is just hiding. Hate to see you get hurt down the road. Dealer can say what he wants now, but what about when it was time to pay up?

If I were in your shoes I would pass it by an attorney that I deal with on a regular basis. Obviously a case of negligence.

The issue here is was the hydraulics playing up before the fluid change,if not then there is the first trouble as a result of what they done,if the hydraulics are still not right have them sort it now while it is fresh in their minds or before they get around to saying you done something wrong.

The hydraulic problems seemed to start about 10-50 hours after the hydraulic fluid change to the wrong fluid. I spoke with someone at ASV (not an engineer however) and they thought I probably had a hydraulic drive motor piston failing. I went around and around with them on the fluid thing - he looked at the specs on the Kubota UDT fluid and said it looked like it shouldn't hurt anything, but then I looked around on the internet and saw notes specifically saying not to use multifunction fluids in Kubota excavators for example. Can anybody out there explain what it is about UDT fluids that makes them incompatible with straight hydraulic systems like on excavators or on my RC100?

In your case, even more would I expect a new machine. 6 months or a year from now, you could have a major failure in the middle of a job because of THEIR screw up. If someone put the wrong automatic trans. fluid in a new truck and it didn't work as well, you'd want a new one because you need something reliable. Your machine is worth 2 new trucks. I'd be on their case big time and also get ASV on their case. ASV doesn't want their machines or dealers to have a bad reputation. If the guy that put the fluid in or the guy that told him to gets fired, so be it. They screwed up! If it shows problems that fast, it can't be good. Dave

You did good! I could never get full price when I traded anything in! Seriously an RC 100 is not a cheap machine by any means. Not far from $100,000 if I'm correct. If I paid that and the dealer put the wrong fluid in it that affected its performance, I'd demand a brand new one! If they won't do that, not only will they lose your business but you certainly won't recommend them to anyone else. The only other option is an extended warrantee on the complete hydraulic system for the life of the machine! How can you really know if there's internal damage? It might not show up right away. I had to put a new wheel motor in my skid steer at 3800 hours and I used the right fluid and changed the filter regularly. The dealer and/or employee screwed up and need to be held accountable. Hope your new machine is trouble free. Hydraulic problems can take a long time to notice before they are real obvious. The wrong fluid might not be compatable with all the different seals in the system etc. I would want a new machine! They could use that one as a rental or something. Dave
