Insure your equipment........

Dad was talking to the shop forman at our local Komatsu dealership the other day and he showed him a small excavator that had been burned to a crisp. Dad said it had gotten so hot it had literally melted the sheet metal as well as part of the counterweight casting. The owner of the machine was burning brush and using it to feed the pile when he parked it and went to lunch. Needless to say he parked it to close to the pile and when they got back the flames were roaring from the machine too. I figure what happened was he parked it with the right side toward the fire and the plastic "site glass" for the fuel tank melted. Then the tank drained and pooled under the machine before running over and bringing the fire back with it. I've heard of this happening several times before to other guys. The owner had just bought the machine and it had less than 200 hours on it when this happened. Bad thing was he didn't have a bit of insurance on it so now he's out ten's of thousands of dollars and has nothing to show for it but a pile of scrap.....BUT IT'S NOT HIS FAULT, IT'S THE DEALERSHIP'S.... The man has said that he's gonna sue the dealership because they didn't tell him to get insurance on his machine in case of an accident.... If this ever makes it to a court I'll be suprised, but this day and age you never know. I can just see it now, you have to get a tag for your tractor just like you do for your car and you have to have proof of insurance to get the tag...and on...and on...and on.... Just something to think about. Wayne

Never mind the dealership. I am surprised the bank did not make him carry insurance to protect their loan.
Or is he well off enough he paid cash ????? ??

Of course its not his fault, as according to todays trial lawyers, nothing is the indivuals fault.

I think he should sue not only the dealership but:

1. The gas station where he bought the fuel. They didn't have a specific language warning that fuel in machines placed next to a raging inferno of brush might exceed the flash point of their product.

2. Komatsu, and all their parent companies and subsideries. They should have known that their machine COULD be used to stack brush, and brush is obviously something that COULD burn. No where in the instructions or operating manuals does it say NOT to park their product next to or in the center of a forest fire.

3. Whoever made the products he ate for lunch. I'll bet the packageing did not have a warning label indicating that the consumer should not consume their product while A. SCUBA Diving, B. during the process of having their gall bladder removed, or C. while leaving expensive equipment parked next to a conflagration of brush.

4. The match company...which started the entire fire to begin with. Does it say in the pack of matches that one should not park things next to fires that were started with their product? I think not!

So, I really think this man was unfairly harmed by corporate america, and he, his family, his unborn children, all his friends, relations, acquaitances, and lawyesr should be justly compensated.

As a minimum, he suffered financial damage, traumatic stress, flash backs, nightmares, acute gingivitis, hyperventilation, halluncintions, and serious other disorders causing irreparable damage.

Others must pay - including corporate america, the small businessman, the greedy insurance companies, (all who deserve to go bankrupt) and yes, all Americans, through higher insurance premiums.

America...this is the very least we can do for this man!

You forgot at least one. He should probably sue God almighty for having creating him in the first place and not forwarning him in the "Good Book" that "thou shalt not park thy Kamotsu any where close to thine raging fire, lest ye have it catch unto fire oh thou of little mind".

The real scarry things are that 1) this guy's vote counts as much as yours or mine, and 2) he's probably able to have children and pass those genes on!

And that is the long term problem with the concept of "one man, one vote". And why historically "democracies" (not republics) do not last much longer than 250 years.

Once more than 50 percent of the voters figure out how to get something for nothing, the system won't work in the long run.
