A while back here in San Diego, the city thought it would be nice to get rid of a Cigar store and coffee shop owned by a guy trying to make a living. In place of it the city thought a Hotel would be a better source of income to the city. The city used the eminent domain law and forced the small guy to sell to the Marriott Hotel chain. The little guy took the city to court and won a judgement against the city for 7.7 million for unfairly taking his properity. Some times the little guy does come out ahead in this country, but not very often. Stan.

This post rekindles the fire that makes my blood boil.
I have seen developers TAKE the last pristine evidence of the beauty and rapture of the old South, and desecrate it, even destroying it"s mansions and monuments in the name of progress for the next generation because of the discrimination it represents to them.

And it still makes me angry.

But...; when they built condos and roads over the wooded hillside cemetaries that we cleaned on Decoration Day every spring when I was a kid..... .let"s just say I hope and pray that I am NOT in Heaven the day those people who made a monetary gain from that land stand in judgement.

That supreme Court ruling was no surprise to me... back in early 90's an Auto Maker wanted a plant here.... Land & Homeowners were made offers well above market price, but they had no choice, they had to sell...Some land had been in the families for many generations, but they had to sell it in the name of "Progress"

Aloha, There are a lot of them 2 legged rat, shade tree politicians ("had to sell it in the name of "Progress" ) that stuff their pockets with green paper "Progress" notes. Big companies scratch their back and they roll over with legs wiggling in the air.

Mahalo,

GOOD, that eminent domain is a bunch of Crap. I read where justice Souter's home in New Hampshire is being looked at by a developer for repossesion and call it lost liberty hotel. The justices that voted for taking private property ought to be boiled in oil.

One of the most important issues of our day and one of the most ignored is the errosion of property rights. If we don"t stand up, losing property is only the beginnnig.

The way the law should be written, is that on private property taken by eminent domain, and especially for sports use, that the original owners should receive a percentage of the profits from such use for however long the facility is used.
Or that land condemned for sports facilites be priced at 3X, 5X, 10X, times the value of property legitimately bought. If these teams and their owners have the money to pay for their sports "heroes" and their criminal activities, they have the money to compensate the property owner.
Lastly, their should be an amendment in each states constitution prohibiting tax dollars from being used to build professional sports facilites. Let the companies that purchase the naming rights to the stadiums go one step further and build the facility.

Professional sports is a business, just like any other business - and they should pay their own expenses and be taxed accordingly.

True but it really doesn' matter how much higher they are made to price the land if the owner doesn't want to sell it. Seems that they are saying well it is yours, we're gonna give you more than it is worth and your gonna have to take it.

We are seeing this same thing happen here in Weakley County Tn.,The local power company wants to build a new office kinda centrally located and is using this new law to get the land. The land owner doesn't want to sell it but I guess he will lose the property anyway just because the government wants to make more tax money on his land.

I guess if you think logically though it makes sense, I mean the government SAYS we own land, We get to pay for it, we get to take care of it and pay for the upkeep,But after it is paid for try not paying your property taxes for several years and you see whose land it really is. ( Notice all of the sarcasm in that statement)

I personally hope the land owner here wins hi fight as I think the government has their nose in way too many things as it is.
