We went to the bank to sign the papers on the new loan that I have been doing over the internet and by phone.

When it came to sign the actual loan only my wife had to sign, wait a minute I own half of that property.

She said the county said that your wife is the only owner.

Went to the county sure enough we are both on the property as owners.

Looked at the papers some more and saw that they had used the 4 acres we have that is adjoining the other 33 acres, that piece is in my wife's name only. (long story don't ask.)

The used the address for the 33 but the description for the 4 and then called it 40 acres.

I called the lady that set this up for me and she said that we could go ahead with it as it is or wait another 15 days to get it straightened out.

Hey if they want to make the loan on my wife's 4 acres that OK with me.

Think I should wait 15 days or take what they have.

I took what they had on the papers, I ain't no Fool.
Walt

You are better off than a guy I was reading about in the Progressive Farmer today. They have a section in there where you can write in and ask a land lawyer questions. He was wanting to buy 24 acres, the county tax man says it is only 11 acres. He wanted to know how to fix the problem.

Always good to read what is written, fine print or not. In 1990, we bought 137 acres out of a 140 that is between our two previous farms. 3 acres was an existing homestead with buildings. Direct deal, no realtor involved, paperwork done by a local attorney. I read everything before signing- told him no deal. Legal description of the property I would have signed for was the 3 acres with a trailer house and an old shed, instead of the 137 acres of bare farm land. Another case before that, when selling Mother"s house, surveyor"s property description was...xxxfeet from a point, then xxx feet, etc. I said xxx feet FROM A POINT- is a circle, not a specific point. Army Green Beret demo training included a course in land survey, paid off again.

I checked on getting a loan to buy a neighbors 90 acre farm.I own three times that much acreage free and clear. The bank wouldn't loan the money because they said it wouldn't pencil out.I told them i had real estate worth 3 times what i was trying to borrow and they still said no.Where are all these deadbeats i hear about on the news every night getting those no collateral loans?

Give the evil banker a lien on some of your paid for land as collateral on the new ground. I bet a dollar you will get the loan.

Wait!!!
33 plus 4 is only 37. if the bank comes up with 40, I would find a new bank.

I would have waited. Sounds like they took the whole thing to me if they are calling it four.
