Here's the senerio.Have a drainage ditch that runs through my neighbor's property and then through mine.This time of the year it has water laying in it.He comes over to my property with his yuppie back hoe and digs out my ditch,making a mess.Pissed me off and I told him so.He said he was worried about mosquito's.Now he wants me to kiss his arse,or he's going to fence in the property line.I told him "fences make good neighbors."The nerve of some people.

Could put a person in a world of trouble to mess with the flow of a ditch, natural or manmade, in over 50% of the states if they didn't get a permit first. His life could get pretty expensive.....

Not sure I understand the fence issue, but no neighbor wolud be doing work on my property uninvited like that - sure understands your feelings.

Now, now don't be too critical. Everybody has talents in various fields and may or may not have honed those talents to perfection.
Some very mechanically inclined people maybe very good as a tool and die maker. Yet be a hazard to them selves and others if they try hydraulics or especially electricity. Those are trade skills too. Let alone other fields. Some people can do astounding body work on vehicles yet you have to help them mix the paint.
I'm always running into stuff on the hobby farm that make for questions .Somehting that either good old Dad did it or I helped with some but..... ..... ..... ..... .. Now I'm winging it on my own and darn? Just "how exactly did that go" or 'the rules have changed" etc.

In most states its against the law to change the flow of any water way without getting lots of permits. I would check with your county to see where your rights are. then if you are right go after him with tooth and nail.

Charge him to correct the damage he did. In a lot of places you have to get a permit before you start messing with a waterway depending on size or if it's a natural creek. He definately should have asked before coming on to your property. I'd make pay to fix any ruts or repland grass, etc.

in south carolina you cant put the fence on the exact lot line unless you have signed paper work. the guy behind me wanted to put in privacy fence. that was fine but he didnt tell me until he was out there diggin post holes. well whatever i told him i only have and 1200 dollars to spend. he finally got the fence up and it looked like 8x8 pallets. he came over a week later wantin a check for 2000 just for my half of the fence. i told him i didnt care what he did i wasnt payin two grand for a bunch of pallets. needless to say it is no longer standing. someone forgot the most important ingredient in the quik-crete and that would be water so it fell over three times before the tornado took it.

i hear ya, we had the next pasture over from us sell, turns out a local hi profile lawyer bought it and wants to raise some cattle on it,]??? aint these people supposed to be smart?] anyway soon here he is with somebody on a backhoe digging up the roping arena over here to repair the irrigation pipe that runs under it,says 'he's fixing it because he has a right to that water' i told him he sure does, but this aint the problem, he digs up the place and finds a small restriction but not enough to stop the flow, to make it short, the problem was the new yuppie up the road,not knowing what 'that rusty antique looking thing with the iron wheel on it' was, backfilled around it with his new kubota when he was 'landscaping', but i got to say that lawyer sure made me a nice arena floor when he refilled his ditch, not a rock in site, guess he dont want to spend his hi value time defending himself for a mistake he made

If your looking to get things drained/tiled, contact your county surveyer office. Ours did wonderful things for me and didn't cost a dime. They have a drainage tax built into property taxes. They said if you want to farm your property, they will provide the means to drain it so you can. Super awesome way to get things done and done right.

watch it...in Virginia, he could put up the fence and charge you for half of the cost for the section between your line.
