Who owns the real estate as in who was it left to? In my state real estate goes to the heirs it was willed to at the deceased death probate and its then owned by them and isn't really part of the estate of the deceased and all owners have equal rights on the property.If you and your brother both own the property he has as much right to use it as he wants as you do.
