You say the vehicle is worth 5K tops. Knock off your deductible. Knock off the salvage value if you keep it. That's what they'll pay you.
NO WAY, NO HOW is the insurance company going to give you anywhere near $8000. Their obligation ends at market value which you say is 5000 tops. They'll probably appraise the market value much lower than 5K based on age and high miles.
