A 400 takes so little hydraulic oil, like 6 quarts, that it's cheap and easy to change it, so why doesn't he? It'll still be a little milky after the first change because you can't get the oil out of the lines and pump, but it will be better.
That said I don't think the milky oil is making a bit of difference in this situation. Milky means the additives in the oil are holding the water in suspension, so it's not "pumping water." It's pumping oil with water droplets suspended in it.
As for the chatter, depends on the chatter. Does the engine seem to be laboring? Does it make a funny noise every little while like a honk or a crunch? Those would indicate internal problems in the hydraulic system such as a blockage.
If it's just vibration... Do the rubber block thing.
