Doesn't take scientific facts to be sued. All it takes is having some money and a lawyer willing to argue to convince the jury.

Do some work on risk analysis, you will soon see humans are utterly terrible at understanding risk and ranking it as its done with a bunch of the emotional/feeling parts of the brain rather than logic or evidence.
