In any store with modern software the POS (point of sale) will not allow a purchase to be consummated without the DOB or other age verification box being checked off. It is not up to the cashier or individual store - they cannot physically make the sale without the verification. No different than alcohol was in the old days before good computer systems came about. Be thankful for the computers - they do save you money by making stores more efficient.
I went through the self-check at Walmart yesterday and when I scanned a can of spar varnish the computer called for an employee to come to the kiosk without me having to ask. That is pretty darned nice
