Oliver farmer, Some areas still have tax free gasoline, but not many as most farmers have gone to diesel for their farming equipment. If you do use a gasoline tractor for farming, then you can I believe fill out a form declaring how much gasoline you use, and have the road tax portion refunded back to you, however, brush hoging the meadow does not qualify for this tax break, as it is considered property maintainance and not farming, just like mowing your lawn. The tractor has to be used for actual farming, whether it is in growing crops or feeding cattle or hauling hay. These are farming activities, and not property maintainance. Trucks, if driven on the roads even though they may be carrying farm products, are not allowed tax free fuel. Its a big temptation to use tax free diesel fuel when hauling grain to the elevator since it is so expensive, but the penalty for getting caught with red diesel fuel far outweighs any benefit of cheating. It doesn't work to tell the arresting officer that you ran out of fuel and the only fuel to get you to the closest fuel depot was that which the friendly farmer had syphoned from his tractor. They have heard that one a zillion times. The government doesn't allow for much leeway in the way of us not paying "our fair share."
