I don't know if I would want to try and force someone to sell me something, or not. You could certainly add to your case by paying with Paypal. You should be able to get your money back through Paypal also. I've recovered payment on an item that the seller didn't ship to me, when I went back through Paypal. Forcing the sale to be honored through the courts could be costly both in terms of expences and the condition of the item that you wind up with. Good luck!
