It would have to be a deeded right of way for him not to be entitled to use it. I suspect you have an "exclusive easement"- this means he can't sell it to anyone else, but he still owns the property, and can use it himself, so long as his use is consistent with your use of it. Your two parcels were obviously subdivided from a 330 X 660 five acre parcel, and it would be unusual for someone going through the subdivision process to do something as stupid as granting a deeded right of way without someone smarter catching and preventing the error along the way.
