Hi virgil,

Let me expand my thoughts. This is a very short version as there's many, many, rules too follow.

DOI=Date of injury
WC= State workmen comp fund
SSA-DIS= SSA Disability Fund
SSA-RET= Normal SSA retirement funds
PPF= private pension funds, IRA's, 401's, etc
PID= private disability insurance

All the above are considered "private" insurance company's in a court of law.

WC is paid from the DOI. CAN be filed with-in 1yr that a known disability exist, using(Federal & State Laws). This will require more than one Doctors opinion of the disability of "can you work at any capacity" and "for how long each work day". If you can earn more than $500/mth at "any" job, then your your benefits will be reduced, most likely too zero, WC or SSA-DIS.

Can you be retrained with-in being cost effective for the insurance company ? A general rule, is if you had been at your profession longer than 25yrs OR 55yo or older, then NO you can not be retrained, and "can be" then considered for pension. This isn't written in "stone" and can change at there whim. A 3rd party is hired to rate your ability. Key here is, "are you in pain while trying all there testing". Doesn't matter what the tests are.

A unwritten rule, is WC will not bother you from the DOI for 6mths. There time that there giving you to "heal up". Take this time too see numerous Doctors of your OWN choosing. Pay cash upon each visit. Obtain a copy of that Doctor#1 chart notes. Take those chart notes of Doc#1 and give too Doc#2 BEFORE the exam begins. Repeat for other Doctors. It's not uncommon too see 20 Doctors before your considered for pension benefits from WC & SSA-DIS. If the Doctor gives you a report in your favor, "then" apply for reimbursement from the insurance company.

"ALL" State, Federal and Private Doctors, you will be video and audio taped at "ALL" times, from the time you get out of your car to the time you get back into your car, including hallways, waiting and exam rooms, elevators, AND can be extended too your home/private property. Do not forget about satellites. You gave your permission for this when you filed for a claim.

"ONLY", WC and SSA-DIS can be considered on your benefit amounts that WC or SSA-DIS pays you.

"All" PPF&PID can NOT be considered by WC or SSA-DIS for reduced benefits amounts. PPF & PID are separate funds but usually require you be to receiving SSA-DIS before paying out your pension benefits.

WC and SSA-DIS have unlimited funds to prove your not disabled.

Now you can see why I suggested a specialized attorney for WC & SSA-DIS as it's very complex.
