All this happened within a few miles of me and I blush to admit it, in the county I live in in SC.
All the failure to follow procedure is what makes the matter more outrageous. I don't know if there was an apperance before a judge before sanity prevailed. I don't know why tests took so long.
I have confidence the family member that kept me informed of the matter is truthful.
SC has a $200,000 limit on the amount a local government is liable for in a law suit. An example of this being applied was well publicized a few years ago. A deputy was answering a call, call canceled, I think lights were turned off, not sure siren ever turned on, Deputy hit a car causing fatality. Jury awarded a large amount in excess of $1million as I recall. The point was made that the county had to apply for the $200k limit and failed to do so, resulting in the large payment to the victim's family.
As to the man getting an underserved payday, If that had happened to me I would have been a lot less understanding than this man was.
