If not, it's his sawmill and his right to sell it whenever and to whomever he has the opportunity. I hate to sound like a hardazz about it, but if you've ever sold ANYYTHING, be it over the internet, through a newspaper classified add, even with a simple FOR SALE sign in your front yard, you'll understand how many "I want it"'s and how many "I'm on the way"'s you get, vs how many actually show up, money in hand and ready to buy.
In the event I have to drive more than a few minutes to see something listed for sale, I always leave my phone # and ask to be called if it sells before I get there.
You can't haul someone into court because they sold something that is theirs to sell. It's unfortunate what happened, but it's sure not criminal.
